This Terms of Service governs your use of the xoxofest.com site, and your participation in XOXO. This is an Agreement between you and XOXO (we, us, etc.).
Let’s keep this short.
By using this website, you agree to be bound by this Terms of Service. If you don’t agree to be bound by this Terms of Service, you may not use this website.
We collect some standard information about your use of the website, which is outlined in our Privacy Policy.
By applying for a ticket to XOXO, you agree that you have read, and you agree to abide by, the XOXO Code of Conduct.
XOXO passes are non-transferable, but your purchase can be refunded in full until Friday, August 19, 2016. After that, all sales are final.
XOXO and xoxofest.com are provided on an at-will and as-available basis. You acknowledge and agree that XOXO shall not be liable to you or any third party for modification or discontinuation of the of the services. Either you or XOXO can terminate this agreement at any time. You may terminate this agreement by ceasing to use any XOXO services. We may terminate this agreement by notifying you at any time via email. Any refund of any price paid to XOXO will be refunded at XOXO’s discretion.
Limitation of Liability and Indemnification
In no event will XOXO be liable for any damages relating to or arising from this Terms of Service. This limitation applies to negligence, applies regardless of the form of action, and applies even if we are made aware in advance of the possibility of the damages in question and even if such damages were foreseeable. The limitations of liability also apply even if your remedies fail of their essential purpose. This limitation of liability may not apply to you to the extent that it is not allowed in some jurisdictions.
Force Majeure
To the extent caused by an act of a god, no delay, failure, or default will constitute a breach of this Terms of Service.
Applicable Law
This agreement falls under the laws of Oregon, and the courts in Portland, Oregon.
